These terms are for people who visit our public website, www.askbrigid.com. They are short on purpose. They explain what you can do on the site and what you can and cannot rely on. They do not take away any right you have by law.
1. Who we are
The website is run by DJG Media Limited, an Irish company, CRO No. 762838, registered office at Coliemore House, Coliemore Road, Dalkey, Dublin, Ireland ("we", "us"). We provide Ask Brigid, a practice-management platform for private clinics, and MyBrigid, a free app for patients. You can reach us at support@askbrigid.com.
2. What these terms cover
These terms cover the public pages of www.askbrigid.com: the home page, the product and feature pages, pricing, the blog, the forms to request a demo or early access, and the legal pages.
They do not cover the apps. The apps have their own terms, and those terms apply when you use them:
- Ask Brigid (for clinics and their staff): the Terms of Service.
- MyBrigid (for patients): the MyBrigid Terms of Service.
If a clinic has signed an order form with us, the order form and the terms that go with it govern the clinic's subscription, not this page.
3. Using the site
You may visit the site and read it, and you may share a link to a page. Please use it fairly. You must not:
- try to get into parts of the site, our servers or our systems that you have not been given access to, or probe, scan or test their security without our written permission;
- send anything harmful to the site, such as malware, or try to overload it;
- copy large parts of the site automatically (scraping), or use it to train a machine-learning model, without our written permission;
- use the site to break the law, to pretend to be someone else, or to send us false information in a form;
- use our name, logo or text in a way that suggests we approve of you or your product.
If you use a form on the site, give us true details. What we do with those details is explained in the Privacy Policy.
We may block access to the site for a person who breaks these terms.
4. General information, not advice
What is on the site is general information about our products and about running a clinic. It is not medical advice, and it is not legal, financial, tax or other professional advice. Nothing on the site creates a doctor-patient relationship. Do not use the site to decide about your own or anyone else's health. If you are a patient, speak to your clinician. In an emergency, call 112 or 999.
If you are a clinic or a clinician, you remain responsible for your own professional judgement, your own legal duties and the decisions you make. Please take your own advice, for example from your professional body, your data protection officer or your solicitor, before you rely on anything on the site for your practice.
The blog
Blog articles are general information, published on the day shown. They are not a statement of what Ask Brigid does today. A product changes, and an article may describe a feature, a price, a rule or a law as it stood when it was written. An article may also have been drafted with the help of software. For what is current, see Features, Pricing and the legal pages listed at the end of these terms. If an article and one of those pages disagree, the page governs.
5. Prices, plans and descriptions
The prices, plan names, plan descriptions and offers on the site are an invitation to ask about our service. They are not an offer that you can accept just by reading them, and they are not a binding promise. A clinic's subscription is created by the order form or sign-up it completes. The order or subscription terms, the Terms of Service and the Refund and Cancellation Policy govern what the clinic gets and pays. Prices may be shown with or without VAT; the order or invoice shows what applies. We may correct a mistake on the site, such as a wrong price, and change the information on it, at any time.
The comparison pages describe other products from public information, as we understand it on the date of the page. Those products change, and the owners may see them differently. Check with the supplier before you decide.
6. Intellectual property
The site, and everything on it, including the text, design, graphics, logos, product screens and the names Ask Brigid and MyBrigid, belongs to DJG Media Limited or to those who license it to us. It is protected by copyright, trade mark and other laws. Third-party names and logos belong to their owners.
You may view the site, and you may print or save a page for your own use, or quote a short extract with a link to the page. You may not copy, republish, sell or change it, or build it into another product, without our written permission. Using the site gives you no right in our software, brand or content other than the right to read it.
If you send us feedback or a suggestion, we may use it to improve what we do, without paying you and without having to say where it came from. We will not publish your name or your personal details with it without your permission.
If you think something on the site infringes your rights, email support@askbrigid.com with the page address and what you are concerned about, and we will look at it.
7. Links to other sites
The site may link to other websites, and other websites may link to us. We do not control those sites, we do not check them regularly, and a link is not our endorsement of the site, its owner or what it says. When you follow a link you leave our site, and the other site's terms and privacy policy apply to you there.
8. Availability
We try to keep the site available, but we do not promise that it will be available all the time, free of errors, or free of anything harmful. We may change it, suspend it or take part of it down, with or without notice, for example for maintenance. A page on the site is not a service-level commitment. Where we have agreed an availability commitment with a clinic, it is in that clinic's order form or service schedule. The live state of our service is shown on our status page.
9. Our liability
Nothing in these terms excludes or limits our liability, or yours, for anything that cannot be excluded or limited under Irish law. That includes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and any right you have as a consumer that the law does not let us take away.
Subject to that, and to the extent Irish law allows:
- the site and its content are provided "as is", for general information;
- we are not liable for loss that arises because you relied on the general information on the site, including blog articles, instead of taking advice or checking what is current;
- we are not liable for loss caused by something outside our reasonable control, for a virus or other harmful material you pick up from the site, or for a site or service run by someone else that you reach through a link;
- we are not liable for loss of profit, business, revenue, data or goodwill, or for indirect or consequential loss, that arises from your use of the site.
This section is about the free public site. Our liability to a clinic that subscribes to Ask Brigid is set by the order form (where there is one), the Terms of Service and the law. It is not set by this section.
10. Privacy and cookies
When you use the site, we collect some personal data, for example when you fill in a form. The Privacy Policy explains what we collect, why, and your rights. The Cookie Policy explains what the site stores on your device. Optional analytics run only if you opt in, and you can change your choice at any time from "Cookie preferences" in the footer.
If you are a patient of a clinic that uses Ask Brigid, the clinic is responsible for your health record, and you should ask the clinic about it. Please do not send health information to us through the website forms or by email.
11. Changes to these terms and to the site
We may change these terms, for example when the site changes or the law does. The version and effective date at the top show which text is current. The new text applies from its effective date, and your use of the site after that date means you accept it. If a change would materially reduce a right you already have, we will say so on the site. We may also change, add or remove pages or features of the site at any time.
12. Irish law and Irish courts
These terms, and any dispute about them or about the site, are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction. If you are a consumer, you keep any right you have under law to bring a claim in the courts of the country where you live, and to rely on the mandatory consumer protection rules of that country.
If any part of these terms is found to be unenforceable, the rest stays in force. If we do not enforce a term straight away, we have not given it up.
